Terms of Service - Brainwidth

1. Acceptance of Terms

By downloading, installing, or using Brainwidth ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.

2. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices you own or control, for your personal, non-commercial use.

3. Free App and Pricing

Brainwidth is currently provided as a free application. There are no subscription fees, in-app purchases, or hidden costs. We reserve the right to introduce paid features or subscriptions in the future, with advance notice to users.

4. No Account Required

Brainwidth does not require you to create an account, register, or provide personal information to use the App. All your data is stored locally on your device and optionally synced with your Apple Calendar, Reminders, and iCloud services through Apple's native integration.

We do not operate servers that collect, store, or process your personal data. The App functions entirely on your device, with data processing happening locally.

5. Acceptable Use

You agree to use the App only for lawful purposes. You may not:

Reverse engineer, decompile, or disassemble the App
Modify, adapt, or create derivative works of the App
Remove any copyright or proprietary notices
Use the App in any manner that could harm our services
Attempt to gain unauthorized access to any systems

6. User Data and Ownership

You retain all rights to your data. Our handling of your data is governed by our Privacy Policy. You are responsible for maintaining the confidentiality of your device and any data stored in the App.

Local Storage: Your tasks, events, routines, and other app data are stored locally on your device using Apple's secure storage frameworks.

Apple Services Sync: If you choose to enable synchronization with Apple Calendar or Reminders, that data will be governed by Apple's terms and will sync across your Apple devices according to your iCloud settings.

Widget: The App includes a home screen widget that displays your data. This widget accesses the same local data stored by the main app on your device.

7. Apple Services Integration

The App integrates with Apple services including Calendar, Reminders, iCloud, and Contacts. Your use of these services is subject to Apple's Terms of Service and Privacy Policy. We access these services only with your explicit permission through iOS permission prompts.

Data synced with Apple services remains under your control and can be managed through your device's Settings app. Revoking permissions will prevent the App from accessing that data but will not delete data already stored by Apple services.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

While we strive to provide accurate cognitive load calculations and helpful productivity features, these are estimates based on algorithms and should not be considered professional medical or psychological advice.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE APP.

Our liability shall not exceed the amount you paid for the App (if any). Since the App is currently free, this means we have no financial liability to you.

10. Termination

You may stop using the App at any time by deleting it from your device. We reserve the right to terminate or suspend your access if you violate these Terms, though we have no means to enforce this given the App's local nature and lack of user accounts.

Upon deletion of the App, all locally stored data will be removed from your device. Data synced with Apple services will remain in those services and must be managed separately.

11. Updates and Modifications

We may release updates to the App through the Apple App Store. While we are not obligated to provide updates, we may do so to add features, improve performance, or address issues.

You are responsible for downloading and installing updates. Older versions of the App may not function properly or may lack security updates.

12. Changes to Terms

We may modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page. Changes will be effective immediately upon posting.

Continued use of the App after changes constitutes acceptance of the modified Terms. We recommend reviewing these Terms periodically. If you do not agree to the modified Terms, you should discontinue use of the App.

13. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the App shall be resolved in the state or federal courts located in California, and you consent to the personal jurisdiction of such courts.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

15. Entire Agreement

These Terms, together with our Privacy Policy and the applicable End User License Agreement (Apple's Standard EULA for App Store applications), constitute the entire agreement between you and Brainwidth regarding the App and supersede any prior agreements.
